On 8 May 2014 the Italian Data Protection Authority (Garante per la Protezione dei Dati Personali) issued decision no. 229, entitled “Identification of simplified arrangements to provide information and obtain consent for the use of cookies”, published in the Italian Official Journal on 3 June 2014. With this decision the Authority implements the European directives under which every website, on a visitor’s first access, must display an information banner explaining the cookie policy of the website being visited, and make continued browsing subject to acceptance of that policy. The full decision is available at https://www.garanteprivacy.it/web/guest/home/docweb/-/docweb-display/docweb/3118884.

Definition

Cookies are small text strings that the websites visited by users send to their device (usually to the browser), where they are stored and then sent back to the same websites on the user’s next visit. While browsing a website, users may also receive on their device cookies sent by different websites or web servers (so-called “third parties”), which may host some elements (such as images, maps, sounds, or specific links to pages on other domains) present on the website being visited.
Cookies, usually present in very large numbers in users’ browsers and sometimes with a long lifespan, are used for different purposes: computer authentication, session monitoring, storing information on specific configurations of the users accessing the server, etc.
In order to regulate the directive correctly, the Authority identified two macro-categories of cookies: technical cookies and profiling cookies. It also made a further distinction based on who installs the cookies, which may be the website operator itself (“publisher”) or a third party that installs cookies through the former, defined as third-party cookies. In the latter case, the Authority expressly limited the publisher’s responsibility to referring users to the information notice of the party installing those cookies.

Technical cookies

Technical cookies are those used solely to “carry out the transmission of a communication over an electronic communications network, or to the extent strictly necessary for the provider of an information society service explicitly requested by the subscriber or user to provide that service” (see Art. 122(1) of the Italian Privacy Code).
They are not used for any other purpose and are normally installed directly by the website owner or operator. They can be divided into browsing or session cookies, which ensure normal browsing and use of the website (allowing, for example, a purchase to be made or authentication to access restricted areas); analytics cookies, treated as technical cookies where used directly by the website operator to collect aggregate information on the number of users and how they visit the website; and functionality cookies, which allow users to browse according to a set of selected criteria (for example, language or products selected for purchase) in order to improve the service provided.
Users’ prior consent is not required for the installation of these cookies, but the obligation to provide information under Art. 13 of the Code still applies.

Profiling cookies

Profiling cookies are designed to create user profiles and are used to send advertising messages in line with the preferences shown by the user while browsing online. Because of how intrusive these tools can be for users’ privacy, European and Italian law require users to be properly informed about their use and to give their valid consent.
They are covered by Art. 122 of the Code, which provides that “storing information in the terminal equipment of a subscriber or user, or accessing information already stored, is permitted only on condition that the subscriber or user has given consent after being informed with the simplified arrangements referred to in Article 13(3)” (Art. 122(1) of the Code). With reference to the above, our website installs on the user’s device only first-party and third-party technical cookies, including:
